The DOL’s guideline is not legal advice, but only a guide on how best to stay compliant with advertising as a real estate agent.

The Dol covers the following…

  • Agent Printed Collateral (Flyers, Business Cards, Postcards, etc.)

  • Agent Websites

  • Agent Social Media

  • Agent Signage

  • Billboards, Radio & TV Commercials

  • Agent Promotional Events (Including Open Houses)

As a Real Estate Agent…

You are required to give FULL DISCLOSURE of your brokerage’s licensed name.

  • Must be the full name of brokerage as it’s been licensed as “Timber Real Estate”

  • The brokerage name cannot be shortened or altered. “Timber,” “Timber RE” and “Timber Realty” are NOT compliant

  • The firm’s name must be “clear and conspicuous”

All internet related advertising that consumers can view or experience, as a separate unit, requires disclosure of the firm’s licensed name. For example, websites must have every viewable page to have the licensed name of the brokerage disclosed.

With social media, the disclosure must be a single-click-away from all social media content which includes online advertising created from social media accounts. For example, if an agent created a walkthrough video of a listing on their instagram page, they must set it up in a way that allows a consumer to click once to see the full disclosure. The easiest way to do this would be to disclose the brokerage name in the agent’s Instagram bio.

With emails, texts, and direct messaging, an agent is required to disclose their brokerage’s licensed name in the first message of whichever form of communication.

For example, if someone received an email from an agent and that agent had their brokerage’s licensed name disclosed in the email footer, then that agent would not be required to disclose through text messaging or direct messaging on social media going forward. However, if the agent did not send an email first that discloses their brokerage’s licensed name, but sent a text message instead, then that agent is required to disclose that information in the text message.

An Agent is Not Shielded…

From Responsibility for False Advertising if They Were Unaware of Doing it.

Advertising can be false, deceptive or misleading even if there is no proof a consumer was misled.

Claiming ignorance won’t protect an agent if they are caught falsely advertising the following: a professional guarantee, performance, accomplishments, service, condition of a property, and much more.

Ways that you can avoid the pitfalls of false advertising…

  • Consider whether statements made in the advertising are likely to change.

  • Get any and all endorsements in writing! Implied endorsements are prohibited.

  • Make sure the “Headline” in your content matches the actual “service.”

  • Do NOT advertise that commissions are “set.” Be sure to advertise that they are “negotiable.”

  • Listing agents MUST update material changes to the status of a listing or property description in a timely manner.

  • Must have approval from the listing agent before displaying their listing. Get this in writing (text or email).

  • If sellers do their own advertising and include the name of their listing agent, they’re required to clearly indicate the firm’s name as licensed.

WHERE CAN I FIND TIMBER’S SOCIAL MEDIA TEMPLATES?

Through your Canva account, you are a team member with Timber’s Canva account. This means that you have access to using Timber’s branded content and your own personal design content. You can access Timber’s Brand Templates by going to the left-side menu, click on “Brand,” and then click on “Brand Templates.”

From there you will have access to several different design templates for social media posts and print signage.

WHERE CAN I ACCESS THE FULL WORKSHOP VIDEO LIBRARY?

You click on “Workshops” in the Timber Mill’s navigation menu. From there you can find a section on this page that says “Full Workshop Library” just below the calendar.
